แนะลูกค้าเปลี่ยนซิมจากดีแทคเป็น DTN มอบข้อเสนอให้ลูกค้าที่ไม่ได้รับความสะดวกในการใช้งานบางพื้นที่
 
 
6 กันยายน 2561 – ดีแทคให้คำมั่นที่จะต่อสู้เพื่อลูกค้า ในการให้บริการโทรศัพท์เคลื่อนที่อย่างต่อเนื่อง หลังสิ้นสุดสัญญาในระบบสัมปทานกับ CAT ในวันที่ 15 ก.ย.2561 ซึ่งในเช้าวันนี้ดีแทคได้ยื่นฟ้องต่อศาลปกครอง เพื่อขอให้ศาลเพิกถอนมติ กสทช. วันที่ 18 กรกฎาคม พ.ศ. 2561 และพร้อมทั้งยื่นคำร้องขอให้ศาลมีคำสั่งทุเลาการบังคับตามมติและ/หรือกำหนดมาตรการหรือวิธีการคุ้มครอง เพื่อบรรเทาทุกข์ชั่วคราวก่อนการพิพากษา เพื่อคุ้มครองสิทธิของผู้ใช้บริการตามประกาศ กสทช. เรื่อง มาตรการคุ้มครองผู้ใช้บริการเป็นการชั่วคราวกรณีสิ้นสุดการอนุญาตสัมปทาน หรือสัญญาการให้บริการโทรศัพท์เคลื่อนที่ (ประกาศมาตรการเยียวยาฯ”) ในระหว่างนี้ดีแทคได้ทุ่มเทอย่างเต็มความสามารถในการขยายโครงข่ายการให้บริการให้เข้าถึงลูกค้า เพื่อชดเชยปัญหาการใช้งานที่อาจเกิดขึ้นในสัปดาห์หน้า
 
นายราจีฟ บาวา รองประธานเจ้าหน้าที่บริหาร กลุ่มกิจการองค์กรและพัฒนาธุรกิจ บริษัท โทเทิ่ล แอ็คเซ็ส คอมมูนิเคชั่น จำกัด (มหาชน) หรือดีแทค กล่าวว่า นับเป็นความรับผิดชอบของดีแทคในการต่อสู้เพื่อลูกค้า โดยในปี 2559 ดีแทคได้เรียกร้องให้มีการจัดประมูลคลื่นล่วงหน้า (Early auction) ตลอดจนแผนจัดสรรคลื่นความถี่(Spectrum roadmap) ซึ่ง กสทช.ได้จัดการประมูลคลื่น 900 MHz เมื่อเดือนกรกฎาคมที่ผ่านมา ก่อนสิ้นสุดสัญญาสัมปทานล่วงหน้าเพียง 2 เดือน นอกจากนี้ ด้วยเงื่อนไขและสถานการณ์ที่แตกต่าง โดยเฉพาะความแตกต่างทางเทคนิคระหว่างคลื่น 900 MHz และ 850 MHz ซึ่งในทางปฏิบัติต้องใช้เวลาประมาณ 24 เดือนเพื่อเปลี่ยนถ่ายอุปกรณ์ใหม่จำนวนมากกว่าหมื่นแห่ง


นอกจากนี้ เพื่อปฏิบัติตามประกาศมาตรการเยียวยาฯ ของ กสทช. เพื่อให้ลูกค้าดีแทคที่ยังอยู่ในระบบสัมปทานเดิม ซิมไม่ดับและมั่นใจในการใช้บริการอย่างต่อเนื่องในวันที่ มิถุนายน ที่ผ่านมา ดีแทค และ CAT ได้ร่วมยื่นแผนคุ้มครองลูกค้ากรณีสิ้นสุดการอนุญาตสัมปทาน ต่อ กสทช. ซึ่งก่อนหน้านี้ กสทช. ได้เคยอนุมัติการเยียวยาแก่ผู้ให้บริการรายอื่นที่เป็นคู่แข่งของดีแทคเป็นระยะเวลา 9 เดือน และ 26 เดือน อย่างไรก็ตาม กรณีของดีแทคที่กำลังจะหมดสัมปทานคลื่น 850 MHz ลงในวันที่ 15 กันยายนนี้  กสทช. ได้กำหนดเงื่อนไขในการได้รับสิทธิเข้าสู่มาตรการคุ้มครองผู้ใช้บริการตามประกาศมาตรการเยียวยาฯ หากดีแทคเข้าร่วมประมูลคลื่น 900 MHz ตามมติ กสทช. วันที่ 18 กรกฎาคม พ.ศ.2561 ซึ่งเป็นการบิดเบือนเจตนารมณ์ของประกาศมาตรการเยียวยาของ กสทช.
 
ในขณะที่ผู้ให้บริการรายอื่น ซึ่งยังไม่ได้นำส่งรายได้จากการให้บริการโทรศัพท์เคลื่อนที่บนคลื่นความถี่ 1800 MHz ในช่วงคุ้มครองผู้ใช้บริการตามประกาศมาตรการเยียวยาฯ ซึ่งดีแทคพูดเสมอว่าเรายินดีที่จะชำระค่าใช้คลื่นในช่วงที่เข้าสู่มาตรการเยียวยาฯ


ขณะที่เหลืออีกเพียง 9 วันก่อนสิ้นสุดสัมปทาน ดีแทคจึงจำเป็นต้องใช้สิทธิตามประกาศมาตรการเยียวยาฯ ยื่นคำฟ้องต่อศาลปกครอง เพื่อขอให้ศาลเพิกถอนมติ กสทช. ดังกล่าว เพื่อสิทธิประโยชน์ของลูกค้าดีแทคในการใช้งานคลื่น 850 MHz โดยปัจจุบัน ดีแทคมีลูกค้าในระบบสัมปทานกับ CAT จำนวน 90,000 ราย นอกจากนี้ ยังมีลูกค้าดีแทคไตรเน็ต หรือ DTN อีกเป็นจำนวนมากที่ใช้บริการข้ามโครงข่ายภายในประเทศ (Domestic Roaming) บนคลื่น 850 MHz ทั่วประเทศ ดังนั้นเพื่อไม่ให้เกิดผลกระทบการใช้งานของลูกค้า กสทช. ดีแทค และ CAT จำต้องร่วมรับผิดชอบในการดูแลคุ้มครองผู้บริโภค ตามประกาศมาตรการเยียวยาฯ ของ กสทช.
 
อย่างไรก็ตาม หากศาลมีคำสั่งคุ้มครองสิทธิการใช้งานของลูกค้าดีแทคบนคลื่น 850 MHz รายได้จากการให้บริการที่เกิดขึ้นในช่วงการคุ้มครองจะถูกนำส่งให้รัฐหลังหักค่าใช้จ่าย ซึ่งทำให้รัฐไม่เสียผลประโยชน์ใดๆ ในทางกลับกัน หากไม่มีการใช้ประโยชน์จากคลื่นความ 850 MHz จะนำความเสียหายมาสู่ทั้งรัฐและผู้ใช้บริการโทรศัพท์เคลื่อนที่ การคุ้มครองการใช้งานชั่วคราวจึงเกิดประโยชน์สูงสุดกับทุกฝ่าย
 
ในระหว่างที่รอการพิจารณาของศาล ดีแทคได้วางมาตรการในการคุ้มครองลูกค้าที่จะได้รับผลกระทบ โดยดีแทคจะดำเนินการแจ้งลูกค้าในรายที่ได้รับผลกระทบจากกรณีที่ไม่ได้รับการคุ้มครองคลื่นความถี่จาก กสทช.
 
นอกจากนี้ เพื่อเตรียมความพร้อมด้านโครงข่าย  ดีแทคได้เร่งขยายเสาสัญญาณ คลื่นดีแทคเทอร์โบ 2300 MHz ของทีโอทีอย่างต่อเนื่อง ซึ่งคลื่นดังกล่าวมีประสิทธิภาพในการดาวน์โหลดสูงสุดในประเทศไทยด้วยความกว้างแบนด์วิดท์ถึง 60 MHz และปัจจุบันสามารถให้บริการครอบคลุม 40% ของประชากรทั้งประเทศแล้ว เพื่อทดแทนประสิทธิภาพของคลื่น 1800 MHz
 
ขณะเดียวกัน ดีแทคยังได้เร่งขยายโครงข่าย 2100 MHz อย่างเต็มความสามารถ เพื่อทดแทนประสิทธิภาพของคลื่น 850 MHz และยังได้ย้ายลูกค้าจำนวน 340,000 ราย ที่ยังใช้ซิมดีแทคเดิมให้เปลี่ยนมาใช้ซิม DTN ภายใต้ระบบใบอนุญาต นอกจากนี้ดีแทคยังได้แบ่งประเภทของลูกค้าที่จะได้รับผลกระทบ โดยจัดตั้งทีมทำงานขึ้นมาดูแลลูกค้าเป็นพิเศษในช่องทางศูนย์บริการ และคอลเซ็นเตอร์ ซึ่งลูกค้าที่ได้รับผลกระทบจะได้รับข้อเสนอ ฟรีดาต้าและโทรฟรีโดยขึ้นอยู่กับการได้รับผลกระทบในการใช้งานของแต่ละคน

dtac vows to defend its customers
 
September 6, 2018 - Today, dtac vowed to fight for its customers’ rights to a smooth transition after the expiry of its concession with CAT on Sep 15, 2018.  Earlier in the day, dtac had filed a lawsuit before the Central Administrative Court for the temporary protection of its customers, in response to the NBTC’s continued failure to allow dtac customers to use the 850 MHz spectrum band. In addition to the lawsuit, dtac outlined how it is aggressively expanding its network and proactively reaching out to customers with compensation for network problems they may be incurring in the coming weeks.
 
UNHEEDED CALLS FOR A SMOOTH TRANSITION
Mr. Rajiv Bawa, Chief Corporate Affairs Officer of Total Access Communication PLC or dtac said: “It is dtac’s duty to fight for our customers. Ever since 2016, we’ve been calling for early auctions and a clear spectrum roadmap. Instead, the NBTC called for an auction on 900 MHz last July, two months before end of concession and with extremely harsh inference conditions. Our network is not even on 900 MHz. It is on 850 MHz, and it would require 24 months to switch from 850 to 900 MHz.”
 
Three months ago, on June 7, dtac and CAT submitted a joint letter to the NBTC asking for the right to provide 850 MHz services after the end of concession in accordance with the NBTC Remedial Measures Notification, similarly to what dtac’s competitors did in the past. NBTC granted them such a protection for durations between 9 to 26 months. But in dtac’s case, NBTC made customer protection on 850 MHz conditional upon dtac’s participation in the spectrum auction for 900 MHz, an unprecedented distortion of the original purpose of the NBTC’s customer protection measures. Unlike other operators who have still not paid NBTC for spectrum usage during remedy period, dtac has always said that it would pay NBTC per the remedy notification
 
TIME RUNNING OUT TO PROTECT CUSTOMERS
With only nine days left before the end of concession, dtac has now been forced to file a lawsuit to revoke the NBTC’s decision. Also dtac petitioned the court for temporary relief measures to allow customers to continue using the 850 MHz network until the court issues a final verdict on the case or until the remedy period is ended in accordance with the NBTC regulation.
 
“In addition to the 90,000 dtac customers under concession with CAT, there are many dtac TriNetcustomers regularly roaming on 850 MHz for nationwide coverage. Ensuring uninterrupted coverage for them is a joint responsibility of the NBTC, CAT and dtac. It is also a legal obligation under the Remedial Measures Notification of the NBTC. Refusal to give remedy will cause irrevocable damage to dtac customers using our 850 MHz network,” said Mr. Bawa.
 
If the court grants an injunction allowing customers to use 850 MHz network during the court process, the state will collect all profits on 850 MHz, meaning customer protection does not damage the state in any way. On the other hand, if customers cannot use the 850 MHz network, this would cause the 850 MHz spectrum to remain idle, damaging both the state and dtac customers irreparably. Temporary customer protection therefore benefits every stakeholder involved.
 
PROACTIVE PROTECTION MEASURES
Beyond its court action, dtac revealed a raft of measures to mitigate the impact of end of concession on its customers. Its dtac TURBO network nows reaches 40 percent of Thailand’s population, and is set to fully make up for the loss of 1800 MHz spectrum before the year-end.
 
dtac TURBO affords the highest download capacities in Thailand. In terms of nationwide coverage, dtac is also aggressively densifying its 2100 MHz spectrum to make up for the potential shutdown of 850 MHz. dtac is also migrating some 340,000 customers using older SIM cards under concession to dtac Trinet.
 
Moreover, dtac will be reaching out to customers it has identified as most likely to be affected by NBTC’s decision. It has ramped up the head counts in its stores and diverted all its call center’s staff to this effort. Affected customers will be offered free data and voice time depending on the severity of the impact.

Starting from Sep 13, customers can dial *777 to check if they are in affected areas. Affected customers will also be contacted proactively. dtac will offer free voice call time and data to affected customers, both on pre-paid and post-paid
 
“Nothing is more important to dtac than our customers. We are doing everything we can to ensure they are treated fairly. They have a right to customer protection and we have a duty to do everything we can to mitigate the effects of end of concession on their network experience,” said Mr. Bawa.
